Commission issues draft determination proposing authorisation of Gentailers’ application for Strategic Energy Reserve Huntly Firming Option

The Commerce Commission has issued a draft determination proposing to authorise Genesis, Contact, Meridian, and Mercury to enter into agreements for the Strategic Energy Reserve Huntly Firming Option. The arrangement would allow these companies to access generation capacity from Genesis’ Rankine Units at Huntly Power Station until 2035, in exchange for an annual premium. The Commission's provisional view is that the arrangement would improve security of supply and lower wholesale prices, outweighing any potential lessening of competition.

Why it matters

This draft determination is significant for energy market participants and compliance teams, as it sets out the Commission's approach to authorising agreements that may otherwise breach competition law, provided there is a net public benefit. It also highlights the Commission's expectations for market transparency and the design of hedge products for third parties.
